Que la situación actual de Dentix es una situación financieramente complicada entiendo que no es ya un secreto a voces debido a que son muchos los medios de comunicación que especulan sobre el futuro de la compañía por lo que los clientes que tienen un tratamiento a medias o incluso muchos que ni tan siquiera han empezado el suyo, estén expectantes y empiecen a buscar la forma de hacer valer sus derechos.
En las próximas líneas vamos a intentar dar unas nociones de qué podemos hacer en caso de que nos veamos afectados por un incumplimiento de contrato por parte de Dentix en cuanto a la realización de un tratamiento se refiere.
Lo primero que debemos tener claro que se debe dar un incumplimiento de contrato por parte de Dentix para poder reclamar lo pagado, ya que puede que no me entreguen en todo o en parte lo que he contratado como parece ser que está pasando a algunas personas que han contratado un tratamiento con Dentix.
¿Cómo recuperar el dinero pagado en efectivo en caso de incumplimiento de contrato por parte de la clínica?
1. Reclamar amistosamente a la clínica.
2. Reclamación a Oficina de Consumidor.
3. Hacer un informe de valoración de lo que se ha contratado y lo que realmente nos han hecho o dejado de hacer. Cuantificación.
4. En caso de no resolverse la controversia de forma amistosa, interponer demanda.
Teniendo claro este primer punto lo primero que debemos hacer es comunicar a Dentix nuestra intención de resolver el contrato por incumplimiento por su parte, por lo que recomiendo que se haga dicha reclamación por escrito y posteriormente, hacer esta misma reclamación ante la oficina del consumidor.
¿Cómo recuperar el dinero pagado financiado en caso de incumplimiento de contrato por parte de la clínica?
Si el tratamiento ha sido financiado con alguna entidad financiera, enviaríamos también una reclamación a dicha entidad financiera al objeto de que esté al corriente de la reclamación que estamos efectuando a Dentix.
1. Reclamar amistosamente a la clínica.
2. Reclamación a Oficina de Consumidor.
3. Reclamar a la financiera.
4. Hacer un informe de valoración de lo que se ha contratado y lo que realmente nos han hecho o dejado de hacer. Cuantificación.
5. En caso de no resolverse la controversia de forma amistosa, interponer demanda.
Es muy importante conocer que si el crédito ha sido tramitado por el mismo Dentix y ha servido única y exclusivamente para financiar el tratamiento bucodental, la financiera no puede cobrarnos un préstamo de un servicio que no hemos recibido en todo o en parte.
Pasado un tiempo prudente, en caso de que no tengamos una respuesta satisfactoria a nuestras demandas, recomendaría hacer un informe médico de la situación en la que nos encontramos en cuanto al tratamiento contratado se refiere para poder reclamar en los tribunales si fuese necesario.
